By installing, accessing, or using Get A Sense, You acknowledge that You have read, understood, and agree to be bound by these Terms. If You do not agree with these Terms, You must not install, access, or use Get A Sense. We reserve the right to update or modify these Terms at any time without prior notice, and Your continued use of Get A Sense after such changes will constitute Your acceptance of the new Terms. 

Subject to these Terms, We grant You a limited, non-exclusive, non-transferable, revocable license to use Get A Sense for Your internal business operations. This license is strictly for the use of Get A Sense as integrated within the Meta platform and Shopify, and does not extend to any other use or platform. 

You agree not to use Get A Sense in any manner that: 

Violates any applicable law, regulation, or guideline. Infringes upon the intellectual property rights of others. Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable. Attempts to disrupt, impair, or interfere with the operation of Get A Sense or the servers or networks connected to it.

All rights, title, and interest in and to Get A Sense, including all related intellectual property rights, are and will remain the exclusive property of the Company and its licensors. Except for the license granted hereunder, these Terms do not grant You any rights to patents, copyrights, trademarks, trade secrets, or any other rights in respect to Get A Sense. 

You must comply with all applicable data protection laws regarding the collection, processing, and management of personal data through Your use of ChatCommerce. You are responsible for obtaining all necessary consents and rights from your customers to process their data in connection with ChatCommerce. 

You agree to keep confidential any proprietary information or materials that You may receive from Us in connection with Your use of ChatCommerce. You shall not disclose such information without Our prior written consent. 

We may terminate Your access to ChatCommerce at any time without notice if You violate these Terms. Upon termination, the license granted herein shall also terminate, and You must cease all use of ChatCommerce and delete all copies. 

ChatCommerce is provided “as is,” and We make no warranties of any kind, whether express, implied, statutory, or otherwise regarding ChatCommerce, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from Your access to or use of or inability to access or use ChatCommerce. 

These Terms are governed by the laws of Delaware without regard to its conflict of laws principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms or ChatCommerce shall be instituted exclusively in the courts of Delaware.

These Terms constitute the entire agreement between You and Us regarding Your use of ChatCommerce. The failure of Us to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
